Terms and Conditions
Effective Date: June 1, 2024

Welcome to Proximity Outsourcing. By accessing or using our services, you agree to be bound by the following terms and conditions (the “Agreement”). If you do not agree to these terms, please do not use our services.

1. SERVICE ENGAGEMENT. The Service provider’s representative, referred to as “Remote Pro/ Remote Professional”, will operate under the general supervision of the client and perform duties as directed by the client.

2. DURATION OF SERVICE. Services commence upon the execution and signing of this agreement by both parties.

3. ONBOARDING. The Client will initiate the onboarding process within five business days from the last date of interview. This means that the client will decide which Remote Pro they’re hiring, so we can officially start the communication for the parties who did not pass this round, too. Payment for the monthly subscription is due no later than two days before the onboarding process.

4. HOLIDAYS AND PAID TIME OFF: Both parties will observe US holidays (New Year’s Day, MLK Day, Memorial Day, Juneteenth, July 4th, Labor Day, Columbus Day, Veteran’s Day, Thanksgiving, and Christmas Day) and Philippine holidays (Maundy Thursday and Good Friday). The REMOTE PRO is entitled to 10 days of paid time off annually. Time off requested by the Remote Pro outside of this is considered unpaid, and will be upon the approval and discretion of the Client.

5. ADDITIONAL BENEFITS. The Service provider will provide basic private insurance coverage, telemedicine services, monthly upskilling seminars, and other merit-based bonuses to the remote pro.

6. DIRECT HIRING. If the Client directly hires the service professional or proceeds to do an engagement with them, a penalty/release fee of $10,000.00 USD is payable to the Service Provider.

7. TERMINATION. Either party may terminate this Agreement with a 30-day written or electronic notice. Prorated service fees will be calculated and paid accordingly if termination occurs before the end of any billing period.

8. CONFIDENTIALITY AND NON-COMPETE. The Service Provider and Remote professional agrees not to disclose any confidential information related to the Client’s business during and for two years after the termination of this agreement.

9. REFUNDS. All services are paid upfront, and considered earned upon the receipt of payment. There are no refunds that are to be made aside from the upfront cost of hiring and recruitment, and the refund is only valid if the interviewed candidates are unfit for the role based on the Action Plan and Resumes presented.

10. CONDUCT. The client and the service provider are expected to exercise good conduct through the entire process of the engagement. There will be no cussing, misogynistic, racist, and offensive remarks in the entirety of our engagement. Failure to comply with this will cause an automatic cancellation of services with no refunds.
